Welcome to LUNA AI Art Generator. These Terms of Service (“Terms”) govern your use of the LUNA AI Art Generator mobile application (“App”) and the website aiartcreator.app (“Website”), operated by Rocket Digital Limited (“we,” “us,” or “our”).

By accessing or using our App or Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Description of Service

LUNA AI Art Generator is a mobile application that allows users to create AI-generated artwork using text prompts and various AI models. The App provides access to multiple AI image generation models, art styles, and creative tools for generating, editing, and sharing digital artwork.

2. Eligibility

You must be at least 13 years of age to use LUNA. If you are under 18, you must have your parent or legal guardian's permission to use our services. By using the App, you represent and warrant that you meet these eligibility requirements.

3. User Accounts

You may be required to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

LUNA offers both free and premium subscription plans. Subscriptions are managed through the Apple App Store, Google Play Store, and our payment processor RevenueCat.

• Subscription payments are charged to your App Store or Google Play account
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions through your device settings
• Refund policies are governed by the Apple App Store and Google Play Store terms

5. Intellectual Property

5.1 Your Content

You retain ownership rights to the original text prompts you submit and the AI-generated images you create using LUNA, subject to the terms of your subscription plan. You are responsible for ensuring that your use of generated content complies with applicable laws.

5.2 Our Content

The App, including its design, features, code, AI models, and branding, is owned by Rocket Digital Limited and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without our written permission.

6. Acceptable Use

You agree not to use LUNA to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create content that infringes on the intellectual property rights of others
• Generate content depicting minors in inappropriate situations
• Attempt to bypass content filters or safety mechanisms
• Use the service for any unlawful purpose or in violation of any applicable regulations
• Interfere with or disrupt the integrity or performance of the service
• Attempt to gain unauthorized access to the App or its related systems

7. Third-Party Services

LUNA integrates with the following third-party services to provide its features. By using LUNA, you also agree to the terms and policies of these services:

• OpenAI — AI image generation (DALL-E models)
• Replicate — AI image generation (various models)
• Fal.ai — AI image generation
• Microsoft Azure — Cloud computing and AI services
• Firebase — Authentication and cloud storage
• RevenueCat — Subscription management
• Google AdMob — Advertising services
• Google Analytics — Analytics and usage tracking
• Meta Pixel — Website analytics and advertising measurement

8. Disclaimer of Warranties

LUNA is provided “as is” and “as available” without any warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that generated content will meet your specific requirements. AI-generated images may occasionally produce unexpected or inaccurate results.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Rocket Digital Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of LUNA. Our total liability for any claims arising from your use of the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Rocket Digital Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may terminate or suspend your access to LUNA at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region. Any disputes arising from these Terms or your use of LUNA shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of LUNA after such changes constitutes your acceptance of the revised Terms.
